The SkyTimer website and the mobile applications and services available in connection with this website (“SkyTimer Service”) are made available to you by Framework Learning, LLC (“Framework”, “we”, or “us”) and are subject to these Terms of Service (“Terms”).
By accessing the SkyTimer service, you agree to be bound by the Terms, which may be updated by us from time to time without notice to you. You can review the most current version of the Terms at any time here. We and third party providers may make improvements and/or changes in the products, services, mobile applications, features, programs, and prices described in the SkyTimer Service at any time without notice. Certain provisions of the Terms may be supplemented or superseded by expressly designated legal notices or terms located on particular pages in this website or SkyTimer Service apps. The SkyTimer Service is not intended for and is not designed to attract children under 13 years of age.
The SkyTimer Service is licensed, not sold, to you for use only under the terms of this agreement, and Framework reserves all rights not expressly granted to you.
By installing any of our apps or otherwise accessing or using the SkyTimer Service or website, you agree that you have read, understood, and agree to be bound by this agreement. If you are using the software on behalf of a company, entity, or organization, then you represent and warrant that you: (i) are an authorized representative of that entity with the authority to bind that entity to this agreement; and (ii) agree to be bound by this agreement on behalf of that entity. If you do not understand or agree to these terms, do not install or otherwise access any of the software or websites associated with this service, then you may not use the software or service.

Some of the SkyTimer Services are billed on a subscription basis (“Subscription”). Subscriptions will be charged to your credit card through your iTunes account. You will be billed in advance on a recurring and periodic basis. Periods are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
Your Subscription will automatically renew unless cancelled at least 24 hours before the end of the current period. You will not be able to cancel the subscription once activated. After purchase, you can manage your subscriptions in App Store account settings or by contacting Apple customer service: https://support.apple.com/billing.
Current pricing for a SkyTimer Plus subscription is US$0.99 monthly or US$9.99 annually. Price may vary by location.
Data and information provided by the SkyTimer service may be delivered securely through the Internet. While these systems are developed to provide high availablity and reliability, unexpected incidents can cause interruption of services.
The Subscription and relevant SkyTimer Service information will automatically be synced across your devices using Apple’s iCloud services. The iCloud service requires that iCloud be activated and the same Apple ID used across devices.
The information on our website and provided within our mobile apps are provided on an AS-IS basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
The SkyTimer service is designed for use by experienced and knowledgeable pilots who must be thoroughly familiar with and competent in, among other things, the use, operation, and navigation of aircraft. The SkyTimer service is for informational purposes only and is not a replacement or substitute for flight instrumentation or flight planning. The data and calculations provided by the SkyTimer service rely on user-provided data and are subject to error. Relying upon accuracy of this information could create a hazard for yourself and others. Comply with aviation regulations and take required preflight action to familiarize yourself with all available information concerning your flight.
You agree to indemnify and hold Framework Learning, LLC, its officers, directors, employees, and agents, representatives, employees, partners and licensors (the “Released Parties”) harmless from any and all indirect, punitive, special, incidental, or consequential damage, including but not limited to, violations, incidents, infractions or accidents which occur either directly or indirectly from the use of this service, website or materials sold by Framework Learning, LLC. In addition, by using this service and/or website, you promise not to sue the Released Parties and agree to hold the Released Parties harmless from any losses, financial or otherwise, which occur directly or indirectly from failure of this website to perform as expected.
You also agree that in no event shall the released parties be liable to you or any third party for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with (a) your use or misuse of the app, (b) your dealings with third party service providers or advertisers available through the app, (c) any delay or inability to use the app experienced by you, (d) any information, software, products, services, or content obtained through the app, whether based on contract, tort, strict liability, or otherwise, even if Framework Learning, LLC has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
Human error may enter into developing and maintaining the SkyTimer service and this website. The information appearing in our software could include technical, typographical, or photographic errors. We do not warrant or guarantee accuracy, completeness or currency of the information provided and we assume no responsibility for the use of the information it provides.
You agree that your rights and obligations shall be governed by the laws of the State of Idaho, United States of America. Any action must be brought exclusively in federal or state courts located in Ada County, Idaho and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
